Terms
How you order, what you receive, and when you can send it back. The German text is the one that counts.
Draft. The marked details are still missing, and the Economic Chamber or a lawyer checks this page before the shop opens.
1. Who you buy from
Christopher Granabetter, sole proprietor trading as Cosmoment, Heidegasse 2, 7062 St. Margarethen im Burgenland, Austria, email: address. These terms apply to every order in the shop on this website. The contract is made in German or in English.
2. How the contract is made
You put your artwork together in the Configurator. What you see there is not yet a binding offer. Before you send your order you see all its details and the total price, and you can change anything. With the button "Order with obligation to pay" you order bindingly and go on to the payment. The contract is made when your payment has arrived. We confirm it by email.
You need no customer account. The confirmation holds every detail of your order and the link to your order page. We keep the text of the contract. You can read and save these terms here at any time.
3. Prices, shipping and payment
All prices are final prices in euros. As a small business we charge no VAT (§ 6 (1) no. 27 UStG).
Shipping to Austria is included in the price. Where shipping to your country costs more, you pay only the difference, as shipping costs. You see the total with all costs before you order.
For a delivery to a country outside the European Union, customs duties, import VAT and the courier's fees may be due. They are not included in the price, and the courier asks you for them.
You pay when you order, on Stripe's payment page (the methods switched on, such as card, Apple Pay, Google Pay, eps) or with PayPal.
4. What you receive
Your artwork shows the sky over the place and at the time you choose, computed from astronomical catalogues. Stars, the Moon and the planets stand at their true positions. The Moon, the planets and the nebulae are enlarged so that you can see them. The colours of a print can differ a little from your screen.
Please check the date, the time, the place and the words before you order: we make exactly what you send.
5. Your words
The titles and place names you type are printed. They must not infringe anyone's rights or break the law. We may refuse an order with such words, and then refund it in full.
6. Delivery
Prints and framed prints are made by our print partner Prodigi in one of its labs (among them the Netherlands, the United Kingdom, the USA and Australia) and sent to the address you give. delivery time: made within … working days, then shipping, per country. Which countries we deliver to you see when you choose the country.
A digital artwork comes as files. The links come by email and stand on your order page, as a rule within … working days of the payment. The links last 120 days, after which we delete the files. Please save them.
7. Withdrawal
As a consumer in the European Union you can normally withdraw from an online purchase within 14 days. For our artworks the law makes exceptions:
- A personal artwork is computed and printed for you alone, from what you tell us (date, time, place, words). For such goods there is no right of withdrawal (§ 18 (1) no. 3 FAGG).
- A digital artwork is delivered at once, at your express request. When you order, you agree that we begin before the withdrawal period ends, and you confirm that you lose your right of withdrawal by that (§ 18 (1) no. 11 FAGG). Your consent is repeated in the confirmation.
8. If something is wrong
The statutory warranty applies. If your print arrives damaged, or does not show the sky you ordered, please write to us as soon as you can, at best within 7 days, with photos of the print and the packaging. We print it again or refund it, at our cost. The 7 days help us claim the damage from the print partner and the courier. They do not limit your rights under the law.
9. Using the pictures
Your artwork is yours to hang, to give and to show. A photo of it on social media is expressly welcome. The files of a digital artwork, the print file among them, are for your own screens and your own prints, and you may give them to a print shop for that. Selling the pictures or the files, or any other commercial use, needs our permission in writing. The copyright stays with Christopher Granabetter.
10. Liability
We are liable for damage as the law provides, but for slight negligence only where a person is harmed. Liability under the Product Liability Act is not affected.
11. Questions and complaints
Write to us at email. We answer as a rule within … working days. Proposal, still to decide: if we cannot agree, we are willing to take part in dispute resolution before the Internet Ombudsstelle (www.ombudsstelle.at).
12. Law and court
Austrian law applies, without the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory law of the country you live in. For claims against consumers the courts the law provides are competent.
What we do with your data is in the privacy notice.
